Choctaw Nation Tribal Courts

The Choctaw Nation Judicial Branch is a fully separate court system from Oklahoma's state courts. It has its own courts, judges, and procedures. The tribal court handles matters that fall under tribal jurisdiction within the Nation's territory. Tribal court records are maintained by the Choctaw Nation and are not part of the state court system.

Tribal court records from the Choctaw Nation are not available through OSCN or ODCR. If you need records from the tribal court, you must contact the Choctaw Nation directly. Their judicial branch has its own online payment system for tribal court matters. The tribal court's jurisdiction is separate from, and in some cases concurrent with, the state court's jurisdiction.

For most traffic stops on state highways and county roads in Choctaw County, citations go to state District Court. Citations issued by Choctaw Nation Lighthorse Police on tribal lands may go through tribal court. If you are unsure which court has your case, check the citation for the issuing agency and contact that agency or the appropriate court clerk.

Oklahoma Traffic Law and Your Driving Record

All state court traffic convictions in Choctaw County count toward your Oklahoma driving record. The Department of Public Safety uses a point system to track violations. Reaching 10 points in a five-year period can lead to license suspension. Points range from 1 to 4 per violation. Reckless driving and failing to stop for a school bus each add 4 points. Speeding convictions add 2 to 4 points depending on how far over the limit you were driving. Careless driving, running a stop sign or light, and failure to yield each add 2 points. Failure to signal adds 1 point.

Fines double in active construction zones and school zones under state law. Certain violations lead to automatic DPS suspension regardless of points, including DUI, driving without insurance, eluding police, and illegally passing a school bus. Taking an approved defensive driving course removes 2 points from your total and is allowed once every 24 months. Speeding fine amounts are set in part by 47 O.S. Section 11-806.
